Privacy Statement

PRIVACY STATEMENT LAST UPDATED: February 2, 2009

The Coca-Cola Company has created this privacy statement (this “Privacy Statement”) in order to demonstrate its firm commitment to privacy.  This Privacy Statement discloses The Coca-Cola Company's information gathering, use and dissemination practices for the information collected through the web site located at www.mycoke.com (the “Site”).  We encourage you to read this Privacy Statement before using this Site.  Your use of this Site signifies that you agree with all terms of this Privacy Statement, so please do not use this Site if you disagree with any part of this Privacy Statement. 

Other sites of The Coca-Cola Company or, from time to time, certain activities on other sites of The Coca-Cola Company might be governed by different privacy practices from those set forth below.  We encourage you to check the privacy statement of each site of The Coca-Cola Company that you visit. This Privacy Statement does not govern our collection of information through any web site where this Privacy Statement is not posted; nor does this Privacy Statement govern the collection of information by third parties (other than collection by The Coca-Cola Company’s service providers through the Site, as set forth herein).

Note Regarding Use of the Site by Children: We do not solicit from or knowingly gather information on anyone under the age of thirteen (13) and we request that such individuals not provide any Personally Identifiable Information (as defined below) through the Site.

  1. THE COCA-COLA COMPANY'S COLLECTION OF INFORMATION

We gather three basic types of information through the Site:  "Personally Identifiable Information" (or "PII"), "Non-Personally Identifiable Information" (or "Non-PII") and IP Addresses.  Personally Identifiable Information is information that identifies you as an individual.  Non-Personally Identifiable Information is aggregated information, demographic information, and any other information that does not reveal specific identifying information about you.  An IP Address is the Internet Protocol address of the computer that you are using.

  1. Personally Identifiable Information

We collect PII from you when you provide it to us while on the Site, such as: your name, address, telephone numbers, email address, account and credit card numbers when you set up an account, enter a sweepstakes, redeem an award, sign up for newsletters, participate in a survey, contact customer service, or otherwise interact with the Site or use certain features on the Site.

  1. Non-Personally Identifiable Information

When you visit and interact with the Site, The Coca-Cola Company and third parties with whom The Coca-Cola Company has contracted to provide services to The Coca-Cola Company may collect Non-PII (for example, a catalog of the Site pages you visit). Non-PII is generally collected from cookies, referrers, IP addresses, environmental variables, pixel tags and similar technologies and information you voluntarily provide.

    1. Cookies.  The Coca-Cola Company and our service providers may use encrypted or non-encrypted cookies in connection with this Site.  Cookies are data that a web server transfers to an individual's computer for recordkeeping and other purposes.  Cookies are an industry standard used by most web sites, and can facilitate users' ongoing access to and use of a particular web site; cookies do not cause damage to your computer systems or files.  If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of a particular cookie, or cookies from a particular web site, to your computer.  For example, cookies allow you to easily log into the Site by remembering your email address.
    1. Environmental Variables.  The Coca-Cola Company and our service providers may also collect various environmental variables, such as the domain from which your computer accessed the Internet, the time you accessed this Site, the type of web browser and operating system or platform used, the computer’s MAC address, the computer type (e.g., Windows or Macintosh), the Internet address of the web site you left to visit this Site, the names of the pages you visit while at this site, and the Internet address of the web site you then visit.  These environmental variables are collected by most browsers, and can be used to optimize your experience on the Site.
    1. Pixel Tags.  The Coca-Cola Company and our service providers may also use so-called "pixel tags," "web beacons," "clear GIFs," or similar means (collectively, "Pixel Tags") in connection with some Site pages and HTML-formatted email messages to, among other things, track the actions of Site users and email recipients, compile aggregate statistics about Site usage, response rates and the effectiveness of marketing and advertising campaigns.
    1. Information You Voluntarily Provide.  We may also collect demographic data, such as your date of birth, gender and zip code, when you voluntarily provide such information to us.  Such information constitutes Non-PII because it does not personally identify you or any other user.  Additionally, we may aggregate PII in a manner such that the end-product does not personally identify you or any other user of the Site, for example, by using PII to calculate the percentage of our users who have a particular zip code.  Such aggregate information is considered Non-PII for purposes of this Privacy Statement.
  1. IP Addresses

Your Internet Protocol (IP) address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP).  This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited.

  1. THE COCA-COLA COMPANY'S USE OF INFORMATION
  1. Personally Identifiable Information

We may use PII about you for the following purposes:

  1. General. PII about you is used by us and our service providers to respond to your requests and fulfill the purpose for which the PII was provided, (e.g., to send newsletters to you or to process and fulfill your payments and transactions) and for administrative purposes (e.g., customer service or to manage promotions).  We may also use PII about you for internal business purposes, such as analyzing and managing our businesses, for example, to study the effectiveness of advertising campaigns, to improve our website and/or our products, to tailor the Site experience and content based on your past activities on the Site, and to gauge customer satisfaction.
  1. Communications. We may use PII about you to send you information about The Coca-Cola Company's programs, to send invitations to you to participate in special programs, to re-contact you if we have not heard from you in a while and, occasionally, to send you advertising/promotional material from some of our Affiliated Entities (as defined below), advertising and strategic partners.  You may opt-out of receiving certain future marketing information or promotional communications (see Section VIII (Opt-Out/Choice) below).  However, regardless of your opt-out preferences, The Coca-Cola Company may still at times need to send program emails for administrative reasons (e.g., to provide you with important information regarding the Site, or changes to our terms, conditions, and policies) – because this information may be important to your use of the Site, you may not opt-out of receiving such communications.
  1. Promotions. Further, we may operate sweepstakes, contests and similar promotions (collectively, "Promotions") through the Site.  We typically ask you for certain PII when you enter and/or, if applicable, win a Promotion, and we will use PII about you to process your entrance and any prizes, as applicable and to announce winners publicly.  You should carefully review the rules, if any, of each Promotion in which you participate through the Site, as they may contain additional important information about The Coca-Cola Company's use of PII about you.  To the extent that the terms and conditions of such promotion rules concerning the treatment of PII about you conflict with this Privacy Statement, the terms and conditions of such promotion rules shall control.

This Site may offer a feature that allows you to send an electronic postcard or otherwise share a message or photograph with a friend.  If you choose to do so, we will ask you for the recipient's name and email address, along with the text of any message you choose to include.  By using this feature, you warrant that you are entitled to use and provide us with the recipient's name and email address for this purpose.

  1. Non-Personally Identifiable Information

Because Non-PII does not personally identify you, we may use such information for any purpose.  For example, we may use this information for The Coca-Cola Company's internal use such as to enhance web site security, to detect broad demographic trends, to assist The Coca‑Cola Company in providing content tailored to your interests, and to otherwise enhance your experience on this Site.  In addition, we reserve the right to share such Non‑PII, which does not personally identify you, with third parties, for any purpose.

In some instances, we may combine Non-PII with PII (such as combining your name with your zip code).  If we do combine any Non-PII with PII, the combined information will be treated by us as PII as long as it is combined.

  1. IP Addresses

We and our service providers use IP addresses for purposes such as calculating Site usage levels, helping diagnose problems with the Site's servers, administering the Site and for the other purposes set forth in Section II(A), and we may disclose IP addresses as set forth in Section III below.  Collecting IP addresses is standard practice on the Internet and is done automatically by many web sites. Please note that we treat IP Addresses, server log files and related information as Non-PII.

  1. DISCLOSURE OF INFORMATION TO THIRD PARTIES

As described below, The Coca-Cola Company may share personally identifiable information, including information that you provide on the Site with third parties that may be located around the world.

  1. Affiliated Entities

We may share information, including PII that you provide on the Site, with our subsidiaries and other entities in which we hold more than a 50% ownership interest (the “Affiliated Entities”) for the purposes described in this Privacy Statement. We require our Affiliated Entities to protect PII about you in a manner consistent with this Privacy Statement.

  1. Special Features on the Site; Co-Branded Sites

From time to time we may enter into a relationship with another company that is not owned by or affiliated with The Coca-Cola Company to provide additional features on the Site (for example, CC Metro is provided by Makena Technologies (“Makena”), and is part of the larger virtual world, there.com).  These special relationships may include co-branded sites (referred to here as co-branded pages).  Any information, including PII, that you provide in connection with one of these features and/or on one of these co-branded pages will be shared with these third party partners. By participating in activities or providing your information on these co-branded pages, you also consent to our providing PII about you to those third parties.  For example, when you register on the Site, if you choose to register to use the CC Metro feature, we will provide certain of the PII that you provide during registration, such as your email address, screen name and password, to Makena for its use in connection with CC Metro and there.com generally.  However, please note that generally, third parties will use PII about you in accordance with their own privacy practices, and so you should check their web sites for information regarding their privacy practices.  PLEASE NOTE THAT THIS PRIVACY STATEMENT DOES NOT ADDRESS THE PRIVACY OR INFORMATION PRACTICES OF ANY THIRD PARTIES.  If you do not want PII about you shared with such third parties, please do not provide PII in connection with the features provided by third parties (such as CC Metro) and/or pages that are co-branded with third parties. 

  1. Strategic Partners

From time to time, we may enter into a special relationship with another company that is not an Affiliated Entity.  We may share your name, email address and zip code with such third-party strategic partners; however, we provide you with the opportunity to opt out of such sharing as explained in Section VIII (Opt-Out/Choice) below.  Because these third parties will use PII about you in accordance with their own privacy practices, you should check their web sites for information regarding their privacy practices.  PLEASE NOTE THAT THIS PRIVACY STATEMENT DOES NOT ADDRESS THE PRIVACY OR INFORMATION PRACTICES OF ANY THIRD PARTIES.

  1. Service Providers

We may use third party service providers to help us operate our business and this Site or administer activities on our behalf, such as financial institutions or credit card companies to authorize and process credit card transactions, and other companies for order fulfillment, delivery, and sweepstakes administration.  We may share PII about you with these third parties for those limited purposes.  For instance, if you participate in a sweepstakes, game, or loyalty program resulting in a prize or reward, we will share PII about you with our games management and merchandise fulfillment agencies.  These service providers are given access to PII needed to perform their functions, but we seek to restrict them from using the PII for purposes other than providing services for us.

  1. Promotion Sponsors

We also reserve the right to share the PII you provide in connection with Promotions with third parties sponsors of Promotions (irrespective of whether those Promotions are hosted by us), or otherwise in accordance with the rules applicable to the Promotion.  You should carefully review the rules, if any, of each Promotion in which you participate through the Site, as they may contain additional important information about a sponsor's or other third parties’ use of PII about you.  To the extent that the terms and conditions of the Promotion rules concerning the treatment of PII about you conflict with this Privacy Statement, the terms and conditions of the Promotion rules shall control. 

  1. Law Enforcement; Assignment

We reserve the right to disclose PII about you to others as we believe to be appropriate (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process (c) to respond to requests from public authorities including public authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates and subsidiaries; (f) to protect the rights, privacy, safety or property of The Coca-Cola Company, its affiliates and subsidiaries, you or others; and (g) to permit us to pursue available remedies or limit the damages that we may sustain.

Further, we reserve the right to transfer any and all information that we collect from Site users to an affiliate, a subsidiary or a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of The Coca-Cola Company's business, assets or stock (including without limitation in connection with any bankruptcy or similar proceedings).

  1. Community Functions

The Site may make available chat rooms, instant messaging clients, forums, blogs, message boards, social networks and/or news groups at various times.  Please remember that any information you disclose in these areas becomes public information and you should exercise caution when deciding to disclose PII about you in any of these forums.  In addition, when you choose to make a posting on such services, certain PII (for example, your first name and last initial, username, and/or location), will be available for other users to view.  We urge you to exercise discretion and caution when deciding to disclose PII about you, or any other information, on the Site.  The Coca-Cola Company cannot prevent such information from being used in a manner that is different from this Privacy Statement and/or the law, and The Coca-Cola Company is not responsible or liable for the results of such postings.

  1. LINKS AND THIRD PARTIES' PRIVACY PRACTICES

This Site may contain links to other sites which are not operated by The Coca-Cola Company, such as CC Metro and The Ignition Network. These linked sites, services and functionality (including without limitation the web sites of Affiliated Entities) are not under The Coca-Cola Company's control and we are not responsible for the privacy practices or the contents of any such linked sites, services and functionality, or any link contained in any linked sites, services and functionality.  We provide such links only as a convenience, and the inclusion of a link on the Site does not imply endorsement of the linked sites, services and functionality by The Coca-Cola Company or any affiliates and subsidiaries of The Coca-Cola Company.  If you provide any PII through any such third party sites, services and functionality, your transaction will occur on such third party's site, service and/or functionality (not the Site) and the PII you provide will be collected by, and controlled by the privacy policy of, that third party.  THE COCA-COLA COMPANY IS NOT RESPONSIBLE FOR THE PRIVACY PRACTICES OR THE CONTENT OF SUCH OTHER WEB SITES.  The Coca‑Cola Company recommends that you review the privacy policy of third party web sites arrived at from links on this Site.  PLEASE NOTE THAT THIS PRIVACY STATEMENT DOES NOT ADDRESS THE PRIVACY OR INFORMATION PRACTICES OF ANY THIRD PARTIES.

The Coca-Cola Company takes reasonable security measures to help protect against the loss, misuse, unauthorized access and unauthorized disclosure or alteration of the PII under its control.  Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure.  As a result, although we strive to protect PII about you, we cannot ensure or warrant the security of any information you transmit to us through or in connection with this Site or that is stored by us.  You acknowledge and agree that any information you transmit through the Site is so transmitted at your own risk.  If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), you must immediately notify us of the problem by contacting us in accordance with Section XI (Contacting The Coca-Cola Company), below (note that physical mail notification will delay the time it takes for us to respond to the problem).

  1. ADVERTISING-RELATED VENDORS

Please note that our online and email advertising-related vendors may use cookies and Pixel Tags in connection with the Site to help manage our online and email advertising campaigns and strengthen the effectiveness of such campaigns.  For example, if a vendor has placed a unique cookie on your computer, the vendor may use Pixel Tags to recognize the cookie during your visit to the Site and to learn which online advertisements of The Coca-Cola Company may have brought you to our Site, and the vendor may provide us with such non-PII for our use.  If you would like more information about this practice and to know your choices about not having this information used by these companies, please visit :
